Software and Firmware Disclaimer

This Software and Firmware Disclaimer applies to any software, firmware, drivers, or digital materials that come preloaded on, or are included with, products you buy from Kitsap Component, including refurbished diagnostic laptops and tablets. It is part of our Terms of Service and Terms of Sale.

Provided AS-IS, no warranty

Any preloaded or included software and firmware is provided "AS IS" and "AS AVAILABLE," with no warranty of any kind. To the fullest extent allowed by law, we disclaim all warranties relating to that software and firmware, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that any software or firmware is current, complete, error free, virus free, or suitable for your equipment or purpose. We do not provide software support, updates, or maintenance unless we agree to in writing.

You are responsible for licensing and authorization

Much of the diagnostic software and firmware used in the elevator-service trade is owned by equipment manufacturers and other third parties and is subject to their own license terms. You are solely responsible for confirming that you are properly licensed and authorized to use any software or firmware on or included with a device, and for complying with the original manufacturer's terms, license agreements, and all applicable laws and regulations. This means, among other things, that:

• you must hold any license, subscription, or authorization that the software's owner requires
• you must not use, copy, or distribute software in a way the owner's license does not permit
• you must comply with the manufacturer's terms for any tool, controller, or system you connect to
• you are responsible for understanding what is preloaded and removing or replacing anything you are not authorized to use

We do not grant you any license to third-party software, and we make no representation that any preloaded software is licensed to you. Any license must come from the software's owner.

No transfer of third-party rights

Selling you a device does not transfer to you any license or other right in third-party software or firmware, and it does not make us the licensor of that software. Where required, you must obtain rights directly from the owner.

Your responsibility for use

You are responsible for how you use any software and firmware, including using it on the correct equipment, by qualified people, and in accordance with all manufacturer instructions, safety practices, and applicable codes and laws. We are not responsible for any loss, damage, downtime, equipment harm, data loss, or legal exposure arising from your use of, or your authorization to use, any software or firmware.

Limitation of liability

The limitation of liability and disclaimers in our Terms of Service and Terms of Sale apply fully to this Disclaimer. To the fullest extent allowed by law, our total liability relating to any software or firmware will not exceed the amount you paid for the product it came with.
